By accessing or using any software, browser extensions, or services provided by Built for Sellers ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our products.

2. Use at Your Own Risk

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF OUR PRODUCTS IS AT YOUR SOLE RISK.

Our tools interact with third-party platforms (including but not limited to Facebook Marketplace, eBay, Poshmark, and other online marketplaces). These platforms have their own terms of service, policies, and rules that may change at any time without notice.

We do not guarantee that the use of our tools will comply with any third-party platform's terms of service now or in the future. You are solely responsible for understanding and complying with all applicable third-party terms.

3. No Warranty & Disclaimer

OUR PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Compatibility with third-party platforms
• Uninterrupted or error-free operation

We make no representations or warranties that our products will meet your requirements, achieve intended results, or operate without interruption or error.

4. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Account suspensions, bans, or restrictions imposed by third-party platforms
• Loss of listings, data, or content on any platform
• Lost profits, revenue, or business opportunities
• Indirect, incidental, special, consequential, or punitive damages
• Any damages arising from your use or inability to use our products
• Any actions taken by third-party platforms against your account

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is less.

5. Third-Party Platforms

You acknowledge and agree that:

• We are not affiliated with, endorsed by, or sponsored by any third-party platform
• Third-party platforms may restrict, suspend, or terminate your account for any reason
• Platform rules and algorithms may change, affecting how our tools function
• We cannot control or predict third-party platform actions or policies
• You are responsible for backing up your own data and listings

6. Acceptable Use

You agree NOT to use our products to:

• Violate any applicable laws or regulations
• Engage in fraudulent, deceptive, or illegal activities
• Infringe on intellectual property rights of others
• Harass, spam, or harm other users
• Attempt to reverse engineer or modify our software
• Resell or redistribute our products without permission

7. Indemnification

You agree to indemnify, defend, and hold harmless Built for Sellers, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of our products, your violation of these terms, or your violation of any third-party rights.

8. Refunds

Refund policies vary by product and are provided at the point of purchase. Generally, we offer refunds within 14 days of purchase if you are not satisfied with the product. However, refunds are not available for issues caused by third-party platform actions or changes.

We reserve the right to modify these terms at any time. We will notify users of material changes by posting the updated terms on our website. Your continued use of our products after such changes constitutes acceptance of the new terms.

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
